Please read these Terms of Use ("Terms") carefully before using the SeedToBody Fertility Tracker mobile application (the "App"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, please do not use the App.

1. Educational Purpose Only ā€” Not Medical Advice

The App is an educational and self-tracking tool. Nothing in the App constitutes medical, clinical, diagnostic, or therapeutic advice, and the App is not a substitute for consultation with a qualified healthcare provider.

  • The cycle, phase, and fertility-awareness information presented in the App reflects general educational content and Aya Maria's teaching on fertility awareness. It is not individualized medical advice.
  • Cycle tracking cannot reliably predict fertile or infertile days for everyone, and the App is not designed as a contraceptive method.
  • The App does not diagnose, treat, cure, or prevent any disease, condition, or medical issue.
  • Always seek the advice of a qualified healthcare professional with any questions about a medical condition, fertility outcome, pregnancy, or reproductive health.

If you think you may be experiencing a medical emergency, call your local emergency services immediately.

2. Eligibility

You must be at least 16 years old to use the App. By using the App you represent that you meet this age requirement. If you are between 16 and the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and accepted these Terms on your behalf.

3. Your Account and Data

  • You are responsible for the accuracy of the information you provide during onboarding and while using the App.
  • You own the data you enter into the App. We do not claim ownership of your cycle logs, journal notes, or observations.
  • Your cycle data is stored on your device. If you uninstall the App or lose your device, that data may be irretrievable. We strongly recommend exporting meaningful records if you wish to preserve them.

4. Mailing List and Communications

If you opt in to receive emails from Aya, we may send you educational content, resources, and information about offerings from SeedToBody. You may unsubscribe at any time by following the unsubscribe link in any email or by contactingĀ [email protected].

5. Acceptable Use

You agree not to:

  • Use the App in a way that violates any applicable law or regulation.
  • Attempt to reverse-engineer, decompile, or otherwise derive the source code of the App except to the extent permitted by law.
  • Use the App to transmit malicious code or interfere with its operation.
  • Use the App to harass, threaten, or harm any person.

We reserve the right to suspend or terminate access to App services (including mailing list subscriptions) if these Terms are materially breached.

6. Intellectual Property

The SeedToBody name, the "SeedToBody" and "SeedToBody Care" brands, the logo, the App's visual design, the "Aya Maria" name as used in the App, and all textual content authored by Aya Maria inside the App ā€” including the in-app fertility guide ā€” are the intellectual property of Aya Maria / SeedToBody Care and are protected by copyright, trademark, and other applicable laws.

You are granted a personal, limited, non-exclusive, non-transferable license to use the App on devices you own or control, for your own personal, non-commercial use. No other rights are granted. You may not copy, reproduce, distribute, publish, or create derivative works from the App's content without our prior written permission, except that brief personal quotation for non-commercial purposes is permitted with attribution to Aya Maria / SeedToBody.

7. No Warranties

The App is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the App will be uninterrupted, secure, or error-free, or that any defects will be corrected.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Aya Maria / SeedToBody Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the App. This includes, without limitation, any outcome related to fertility, conception, contraception, pregnancy, pregnancy loss, or any other reproductive or health outcome.

To the extent any liability is ultimately found, our aggregate liability for all claims arising out of or relating to the App shall not exceed the greater of (a) the amount you paid us for the App, if any, in the 12 months preceding the claim, or (b) US $50.

Some jurisdictions do not allow limitations on implied warranties or liability for certain damages ā€” in those jurisdictions, the limitations above apply only to the extent permitted.

9. Indemnification

You agree to defend, indemnify, and hold harmless Aya Maria / SeedToBody Care from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the App or your violation of these Terms.

10. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to App services (for example, mailing list subscriptions) at any time for any reason, including breach of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. If the changes are material we will make a reasonable effort to notify you (for example, by an in-app notice or by email to opted-in users). Continued use of the App after an update constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Aya Maria's principal place of business (as published on the SeedToBody website), without regard to conflict-of-law rules. Any disputes shall be resolved in the state or federal courts located in that jurisdiction, except where applicable consumer-protection law provides otherwise.

13. Apple-Specific Terms

If you obtained the App through the Apple App Store:

  • These Terms are between you and Aya Maria / SeedToBody Care only, not with Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government restricted-party list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
